Hecox v. Little is one of several ongoing lawsuits in the country regarding bans on transgender athletes in women’s sports. BPJ v. West Virginia is on track to be heard at the Supreme Court next year, becoming the first time the Court has directly weighed in on the controversy.
27 states have enacted laws banning transgender athletes from playing sports in school programs. This was further pushed by the Trump Administration’s executive order to withdraw funding from schools that allow transgender athlete participation.
U.S District Judge David Nye rejected former BSU student Lindsay Hecox’s motion to dismiss her lawsuit. She sued in 2020 in an effort to block enforcement of the Fairness in Women’s Sports Act. The Supreme Court agreed to take up the case in July.
Hecox now cites “negative public scrutiny” because of the litigation and wants to quote “focus on her academic and personal goals.”
Both Idaho Attorney General Raul Labrador and the Alliance Defending Freedom have fought the attempt to drop the case. Both agreed with Judge Nye that Hecox’s arguments to drop were manipulative to avoid Supreme Court review.
